By accessing and using the Anibirds website at www.anibirds.org (the "Site") and any related mobile or software applications ("Anibirds Platform"), you agree to comply with the following terms and conditions:
1. Definitions & User Roles
For the purposes of these Terms and Conditions, the following definitions apply:
Any individual or organization who accesses or uses the Anibirds Platform, whether through the website or mobile application. A user may act in the capacity of a Donor, Customer, or both.
Donor: A user who contributes funds through the Anibirds platform for the welfare of animals and birds. These donations are directed to registered NGOs, shelters, or verified feeders, and may be eligible for tax exemption under Section 80G of the Income Tax Act, 1961 (see Clause 19).
Customer: A user who purchases pet food, pet services, or any other product or service offered via the Anibirds platform for personal or commercial use. Such transactions are considered commercial in nature and may attract applicable taxes such as GST.
A single user may operate in multiple capacities — as a donor (for charitable causes) and as a customer (for purchasing goods/services). Each transaction shall be governed by its applicable legal and financial framework.
1.2 Vendor Partner
Any third-party entity registered with Anibirds that provides goods or services — including but not limited to:
Pet food manufacturers or distributors
Animal feed suppliers
Pet service providers (veterinary clinics, grooming centers, trainers, etc.)
All vendor partners are responsible for maintaining legal compliance including FSSAI (if applicable), GST registration, and other statutory licenses.
1.3 Delivery Partner
Any individual or organization engaged in the pickup, transport, and delivery of goods or services facilitated through the Anibirds platform. Delivery partners are either:
Independent third parties
Registered volunteers
NGO team members
They are expected to follow hygiene, safety, and ethical handling norms while transporting any animal-related goods or donations.
2. Acceptance of Terms
By using the Anibirds Platform, you acknowledge and agree to be bound by these Terms of Use. These Terms constitute a legally binding agreement between you and the Social Fighter Foundation. If you do not agree with these Terms, please do not use the Anibirds Platform.
3. Services Overview
Anibirds serves as a platform for individuals and corporations to donate food for animals and birds. The platform facilitates on-demand food donation services and offers sponsorship opportunities for feeding points. Anibirds does not directly provide services but acts as an intermediary connecting donors with recipients.
3.1 On-Demand Food Donation: Donors can select from a variety of food items listed on the platform, specify the quantity, and choose a delivery method.
3.2 Sponsorship Opportunities: Donors can sponsor specific feeding points or participate in recurring donation programs to support ongoing feeding efforts.
3.3 Transparency and Accountability: Anibirds provides updates and reports on how donations are utilized, ensuring transparency and building trust with donors.
3.4 Vendor Agreements and Food Safety Compliance: All third-party vendors, including NGOs, shelters, kitchens, and restaurants registered on the Anibirds Platform, operate under individual service-level agreements (SLAs) signed with the Social Fighter Foundation. These agreements include clauses for transparency, lawful operation, hygiene, and food safety compliance. Partners involved in food preparation and delivery (including kitchens, pet cafés, or mobile units) must hold a valid FSSAI license and comply with relevant local health and safety regulations.
It is mandatory for all food-preparing partners to possess valid FSSAI (Food Safety and Standards Authority of India) licenses, adhere to local regulations, and ensure hygienic food handling and delivery. Copies of FSSAI licenses are collected and verified during vendor onboarding and are available upon request to relevant stakeholders.
4. Eligibility
The Anibirds Platform is open to all individuals and corporations willing to donate food for animals and birds. However, minors under the age of 18 must use the platform under the supervision of a parent or legal guardian. Retailers, wholesalers, and other commercial entities are not eligible to use the platform for purchasing products from third-party sellers.
4.1 User Responsibility: Users are responsible for ensuring that their use of the platform complies with all applicable laws and regulations.
4.2 Account Suspension: Anibirds reserves the right to suspend or terminate accounts that violate these eligibility requirements.
5. License & Access
Users are granted a limited license to access and use the Anibirds Platform for personal and non-commercial purposes. Users may not modify, reproduce, or distribute any content from the platform without prior written consent from the Social Fighter Foundation.
5.1 Prohibited Actions: Users may not use the platform to engage in any unlawful activity, infringe on intellectual property rights, or disrupt the services provided by Anibirds.
5.2 Access Restrictions: Anibirds reserves the right to restrict or terminate access to the platform for users who violate these terms.
6. Account & Registration Obligations
All users must register and log in to the Anibirds Platform to donate food. Users agree to provide accurate and current information during the registration process. By registering, users consent to receive promotional or transactional communication from Anibirds and its partners.
6.1 Account Security: Users are responsible for maintaining the confidentiality of their account information and for all activities that occur under their account.
6.2 Account Termination: Users may terminate their account at any time by contacting Anibirds support. Anibirds may also terminate accounts for violation of these terms.
7. Pricing
Anibirds aims to ensure that prices of donated food items are accurate. However, occasional discrepancies may occur due to technical issues or incorrect information provided by third-party stores/donors. In such cases, Anibirds reserves the right to cancel orders without liability.
7.1 Price Adjustments: If a pricing error is identified, Anibirds will notify the user and provide options to confirm the order at the correct price or cancel it.
7.2 Refund Policy: In the event of a canceled order due to pricing discrepancies, refunds will be processed promptly according to the payment method used.
7.3 GST Applicability:
Please note that GST is applicable **only** on purchases made under the **Pet Zone** section, such as pet food, accessories, and grooming services. These are commercial transactions fulfilled by verified third-party vendors and are invoiced accordingly.
All contributions made towards animal and bird feeding, NGO donations, and sponsorships are treated as **pure charitable donations**, and thus **do not attract any GST**. Donors receive acknowledgments and transparency reports, but no tangible product or service, making such donations non-taxable under applicable laws.
8. Reviews, Feedback, Submissions
Users may submit reviews, feedback, or other submissions related to their experience with the Anibirds Platform. By submitting content, users grant Anibirds the right to use, reproduce, and publish such content without compensation. Users agree not to submit unlawful, defamatory, or offensive material.
8.1 Content Guidelines: Submissions must comply with community standards and should not contain any harmful, abusive, or misleading information.
8.2 Moderation: Anibirds reserves the right to moderate, edit, or remove any user submissions that violate these guidelines.
9. Copyright & Trademark
All intellectual property rights related to the Anibirds Platform belong to the Social Fighter Foundation. Users may not modify, distribute, or repost any content from the platform without prior consent. The use of trademarks or logos without permission is prohibited.
9.1 Ownership: All content on the platform, including text, graphics, logos, and images, is the property of Anibirds and is protected by copyright laws.
9.2 Usage Permissions: Any use of the platform's content for commercial purposes requires written permission from Anibirds.
10. Indemnity
Users agree to defend, indemnify, and hold harmless the Social Fighter Foundation and its affiliates from any claims arising out of breach of these Terms or violation of applicable laws.
10.1 Scope of Indemnity: This indemnification covers all legal fees, damages, and other expenses incurred by Anibirds as a result of user actions.
10.2 User Cooperation: Users agree to cooperate fully with Anibirds in the defense of any claims that arise.
11. Limitation of Liability
The Social Fighter Foundation shall not be liable for any indirect, special, or consequential damages arising from the use of the Anibirds Platform.
11.1 Direct Damages: Anibirds' liability for direct damages shall be limited to the amount paid by the user for the services provided.
11.2 Force Majeure: Anibirds shall not be liable for any failure to perform due to circumstances beyond its control, including natural disasters, technical failures, or other unforeseen events.
12. Termination
The Social Fighter Foundation reserves the right to terminate or suspend access to the Anibirds Platform at any time without prior notice. Users may also terminate their account at any time by discontinuing use of the platform.
12.1 Termination for Cause: Anibirds may terminate user accounts for violations of these Terms or any applicable laws.
12.2 Effect of Termination: Upon termination, users will lose access to their account and any data associated with it. Anibirds is not obligated to retain any information following termination.
13. Governing Law & Jurisdiction
These Terms of Use shall be governed by the laws of India. Any disputes arising from these Terms shall be resolved through arbitration in Delhi, in accordance with the Arbitration and Conciliation Act, 1996.
13.1 Arbitration Process: Disputes will be resolved by a single arbitrator appointed in accordance with the rules of the Arbitration and Conciliation Act.
13.2 Jurisdiction: The courts of Delhi shall have exclusive jurisdiction over any appeals or enforcement of arbitration awards.

17. User Responsibilities and Commitments

18.1 Scope of Services: Pet Zone may include, but is not limited to:
Purchase of pet food and accessories
Pet-friendly restaurants (Pet Resto)
Pet salons and grooming services
Veterinary clinics and doctors on demand (home visits)
Pet boarding, training, and daycare
Pet transport and ambulance services
Pet cremation and related services
18.2 Commercial Nature: All Pet Zone offerings are considered commercial transactions, subject to applicable taxes (e.g., GST) and do not fall under the scope of charitable donations or 80G exemption.
18.3 Vendor Responsibility: These services are rendered by third-party vendors who are independently responsible for:
Service quality, delivery, and timelines
Compliance with laws (e.g., FSSAI for food, veterinary licenses, transport permits)
Hygiene, animal safety, and any associated risks
Anibirds acts solely as a facilitator/aggregator and bears no direct liability for execution, delays, damages, or disputes. Anibirds does not guarantee the effectiveness, safety, or compatibility of any third-party product or service listed under the Pet Zone. Users are expected to conduct due diligence. Anibirds shall not be held liable for any pet health issues, allergies, or adverse reactions resulting from such use.
18.4 Refunds & Complaints: Refunds, cancellations, or service-related grievances must be directed to the respective service provider. Anibirds will assist in coordination where possible but does not guarantee outcomes.
18.5 Future Offerings: Additional services introduced under the Pet Zone (whether online, in-person, or via third-party integrations) will be governed by the same commercial and legal standards mentioned herein, unless explicitly specified otherwise.
19. Delivery and Order Policies
19.1 GST Effect on Delivery: In compliance with GST regulations, our invoices reflect applicable exemptions. While our delivery processes remain unaffected, they may entail distinct components for GST-exempt items.
19.2 Order Limits and Minimum Order Value
20. Other Terms
20.1 General Terms: Promotional endeavors on the Anibirds Platform adhere to specific terms and conditions. To partake in offers, users must conform to these stipulations.
20.2 Key Points:
20.3 Liability: Anibirds disclaims liability for services dispensed by third-party entities within the ambit of promotional campaigns. Users hold Anibirds indemnified against any claims arising from participation in promotional activities.
Donations made to the Social Fighter Foundation through the Anibirds Platform are eligible for tax exemption under Section 80G of the Income Tax Act, 1961, subject to applicable limits and terms.
Donors will receive a valid 80G donation receipt and certificate via email within 10–15 working days of a successful donation made on the Anibirds platform. This certificate can be used to claim deductions while filing income tax returns.
Only pure donations made to support animal and bird welfare initiatives via the Anibirds platform are covered under 80G. Commercial purchases such as pet food, pet services, or any order placed under the "Pet Zone" are not eligible for 80G exemption and may attract applicable taxes such as GST.
In case of any discrepancy or failure to receive the 80G certificate, donors are advised to contact us at support@anibirds.org with their transaction ID and registered email address.
21.4 Use of Donations
All donations are strictly used for activities aligned with the goals of the Social Fighter Foundation. Any attempt to misuse, redirect, or commit fraud in relation to donations may result in account suspension, reporting to relevant authorities, or legal action under applicable Indian laws.
21.5 Donor Visibility
